1. Overview

This website is operated by Nibbl, based in Markham, Ontario, Canada. Throughout the site, the terms we, us and our refer to Nibbl. By visiting our site or buying something from us, you agree to the terms below. If you do not agree to them, please do not use the site.

2. Who may order

You must be the age of majority in your province, state or territory to buy from us, or have the consent of a parent or guardian. You may not use our products for any unlawful purpose, or breach any law of your jurisdiction while using this site.

3. Products

Our products are heat sealers with a built-in cutting blade. They contain a rechargeable lithium battery and a heating element. Read the instructions before use, keep them away from children, and do not use them on anything other than the plastic and foil bag materials they are designed for.

We have made every effort to display product colours and dimensions accurately, but we cannot guarantee that your screen shows colours exactly. Product images are representative.

We reserve the right to limit the quantity of any product we sell, to change product descriptions and pricing at any time, and to discontinue a product.

4. Pricing and payment

Prices are shown in Canadian dollars for customers in Canada and in United States dollars for customers in the United States. Prices are subject to change without notice.

We reserve the right to refuse or cancel any order, including orders that appear to be placed by dealers or resellers, orders with a pricing error, and orders we suspect are fraudulent. If we cancel an order you have already paid for, we refund it in full.

5. Shipping and returns

Shipping times, costs and duties are set out in our Shipping Policy. Returns, refunds and cancellations are set out in our Refund Policy. Both form part of these terms.

6. Accuracy of your information

You agree to give current, complete and accurate purchase and account information, including a correct shipping address and email. We are not responsible for orders that fail to arrive because the information you gave us was wrong.

7. Third party links and services

Our site may link to third party sites or use third party services such as payment processors and analytics tools. We are not responsible for the content or practices of those third parties. Complaints about a third party product or service should go to that third party.

8. Your submissions

If you send us comments, reviews, photos or suggestions, we may use, copy and publish them without restriction and without paying you. We may edit or remove anything we consider unlawful, offensive or defamatory. You agree that what you send is your own and does not violate anyone else's rights.

9. Disclaimer and limitation of liability

We do not guarantee that your use of our service will be uninterrupted, timely, secure or error free. Our products and services are provided as is, except where the law does not allow that.

To the extent permitted by law, Nibbl is not liable for any indirect, incidental or consequential loss arising from your use of the site or our products. Where liability cannot be excluded, it is limited to the amount you paid for the product in question. Nothing here limits your rights under the Consumer Protection Act, 2002 of Ontario, the Competition Act, or any other consumer protection law that applies to you.

10. Indemnification

You agree to indemnify and hold harmless Nibbl and its contractors from any claim or demand, including reasonable legal fees, arising out of your breach of these terms or your violation of any law or third party right.

11. Changes to these terms

We may update these terms at any time by posting a new version on this page. The date at the top shows when they last changed. Continuing to use the site after a change means you accept it.

12. Governing law

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply in it.
